This blog is by way of update to my previous blogs re: the Pennsylvania Supreme Court’s products liability case, Tichner v. Omega Flex, Inc., 104 A.3s 328 (Pa. 2014). While various courts have declined to extend its holding, Tichner and its progeny remain steadfast, providing that the threshold determination in a defective design strict liability case remains an issue for the fact finder, not a question of law for the court to determine.
